The terms of using Turnflow

1. Who these terms are between

These terms are an agreement between you (and the organization you act for) and CertioFlow ("Turnflow", "we", "us"). By signing in or submitting a request, you accept them. If you use Turnflow for an organization, you confirm you're authorized to accept these terms on its behalf.

2. The service

Turnflow completes security and compliance questionnaires using the evidence documents you provide, such as audit reports and policies. For each request we return your questionnaire with answers, supporting citations, and notes on questions your evidence doesn't cover. We aim to deliver within 24 hours of a completed upload; this is a target, not a guarantee, and we'll tell you if a request will take longer.

3. Your responsibilities

1. You only upload documents you have the right to share with us, including under any confidentiality or non-disclosure terms that apply to them.
2. The documents you provide are accurate and current to the best of your knowledge.
3. You review every completed questionnaire before submitting it to anyone. You decide what is finally represented to your customers.
4. You don't use the service to upload unlawful content, malware, or documents unrelated to a questionnaire, or try to access other clients' requests.

4. What the deliverable is, and isn't

Answers are prepared from, and limited to, the documents you supply. They describe what those documents say; they are not an audit, certification, legal advice, or an independent assessment of your security. Where evidence is missing or qualified, we leave answers blank or qualified rather than guess, so some questions may need your input. You remain responsible for the accuracy of anything you submit to a third party.

5. Confidentiality and your data

We treat your documents and completed questionnaires as confidential. We use them only to provide the service, through service providers that act on our instructions, as described in our privacy policy. Uploaded files and completed questionnaires are deleted 14 days after delivery. You keep all rights to your documents and to the completed questionnaire.

6. Fees

Fees are shown on our pricing page before you submit a request, unless we have agreed a different price with you in writing. Fees are invoiced on delivery. If you cancel a request before it is delivered, we refund any amount paid for it in full. If we deliver a request after the due time shown in your workspace (24 hours after upload), we refund 50% of the fee paid for it, or reduce its invoice by 50%, automatically on delivery ("on-time guarantee"). Fees are non-refundable once a completed questionnaire has been delivered.

7. No warranty

We provide the service with reasonable care and skill. Beyond that, and to the extent the law allows, the service and deliverables are provided "as is", without warranties of any kind, including fitness for a particular purpose or that every question will be answered.

8. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental or consequential losses, including lost business, contracts or profits, and our total liability for any claim relating to the service is limited to the fees you paid for the request concerned. Nothing in these terms limits liability that cannot be limited by law.

9. Suspension and ending

You can stop using Turnflow at any time. We may suspend or end access if these terms are breached or the service is misused. Sections 4, 5, 7, 8 and 10 continue to apply after use ends.

10. Changes and governing law

We may update these terms; the date above shows the latest version, and changes apply to requests submitted after that date. These terms are governed by the laws of Texas.
